1. Acceptance of these terms

These Terms of Use are an agreement between you and Stature ("Stature," "we," "us") governing your access to and use of staturestrategy.com and its content (the "Site"). By using the Site, you accept these terms. If you do not accept them, please do not use the Site. Your use of the Site is also subject to our Privacy Policy.

2. Permitted use

You may use the Site for lawful purposes related to evaluating, engaging or working with Stature. You agree not to:

  • use automated means to scrape, harvest or copy the Site or its content, except for search engine indexing consistent with our robots.txt;
  • attempt to gain unauthorized access to the Site or any related system, or interfere with its operation or security;
  • use the Site or any contact channel on it to transmit unsolicited commercial email, spam, or malicious code;
  • submit information that is false, misleading, or that you do not have the right to share;
  • use Stature's content to build or train a competing service, product or database without our written permission.

3. Intellectual property

The Site and its content — including text, graphics, illustrations, the mountain visual system, layout, and the Stature name, logo and the tagline "Stand Tall. Think Forward." — are owned by Stature or its licensors and are protected by copyright, trademark and other laws. You may view, download and print reasonable portions of the Site for your own internal, non-commercial reference, provided you do not remove any copyright or attribution notices. All other use, including reproduction, republication, distribution or creation of derivative works, requires our prior written consent.

4. Submissions and communications

When you submit information through a form on the Site or by email — including a résumé, an inquiry, or a newsletter signup — you represent that the information is accurate and that you have the right to provide it. We handle that information as described in our Privacy Policy, and for candidates as described in the candidate data section.

Do not send us confidential or proprietary business information through the Site before we have a signed engagement or confidentiality agreement in place. Unsolicited ideas, proposals or materials are provided on a non-confidential basis, and we are free to use them without obligation to you. Internet transmission is not secure — please do not send sensitive personal information such as Social Security numbers or financial account details by unencrypted email.

5. No professional or employment relationship

The Site provides general information about Stature's services. Nothing on it constitutes accounting, tax, legal, investment or other professional advice, and nothing on it creates a client, advisory or engagement relationship. A Stature engagement begins only under a written agreement signed by both parties.

Similarly, nothing on the Site is an offer of employment or a guarantee of placement, consideration, compensation, or continued engagement. Submitting your information does not create an employment relationship with Stature or with any client.

6. Accuracy of content and performance data

We work to keep the Site accurate and current, but we make no warranty that it is complete, error-free or up to date, and we may change or remove content at any time without notice.

The Site presents placement retention and tenure data drawn from Stature's own engagement records. That data reflects historical outcomes observed as of the date stated where it appears, includes only placements assessable at each milestone as described in the accompanying methodology note, and is provided for informational purposes. Historical outcomes do not guarantee future results.

7. Third-party links

The Site links to third-party sites, including LinkedIn. We do not control those sites, do not endorse their content, and are not responsible for their availability, accuracy, terms or privacy practices.

8. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, STATURE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS OR HARMFUL COMPONENTS.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STATURE AND ITS OWNERS, PARTNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, LOST BUSINESS OPPORTUNITY OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain of these limitations, in which case they apply to the maximum extent permitted. This section does not limit liability for our own fraud or for anything else that cannot be limited by law, and it does not govern liability under a signed engagement agreement, which has its own terms.

10. Indemnification

You agree to indemnify and hold harmless Stature and its owners, partners, employees and agents from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising out of your breach of these terms or your misuse of the Site.

11. Governing law and disputes

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Site will be brought exclusively in the state or federal courts located in the State of Michigan, and you consent to the personal jurisdiction of those courts. Any claim must be brought within one year after it arises.

12. Changes and contact

We may revise these terms at any time. The "last updated" date above reflects the current version, and your continued use of the Site after a revision constitutes acceptance of it. If any provision is found unenforceable, the remainder stays in effect. These terms, together with the Privacy Policy, are the entire agreement between you and Stature regarding the Site.
